Privacy Notice
I. Responsible for the Protection of Personal Data.
WTDS, Inc., hereinafter "WTDS", with address in Colorado, Georgia, and Maryland, United States, is responsible for the processing of personal data collected for the processing of applications and opening of financing, in terms of what is established by article 3, section XIV of the Federal Law for the Protection of Personal Data in Possession of Individuals (LFPDPPP).
II. Purposes of Personal Data Processing and type of data collected.
The personal data collected by "WTDS" collected physically through application and financing opening forms, as well as those requested by electronic means such as applications (Apps), and websites managed by the company, will be processed for the processing, evaluation and opening of financing, as well as for the administration and maintenance of the services offered by "WTDS", in terms of what is indicated in this section.
a) General data
The general personal data collected such as: name, age, address, nationality, email, signature, valid official identification, passport or respective national identity document, phone number, cell phone, work phone, current employment and seniority in the same, are used for the following essential purposes of processing:
- Register our clients in our systems and databases for the administration of the financing granted;
- Process financing applications from those who require our services;
- In case of approval, formalize the opening of the granted financing;
- For the administration of the contract signed by the borrower;
- Comply with current legal provisions in the United States, applicable to the provision of our services, such as the Federal Law for the Prevention and Identification of Operations with Resources of Illicit Origin (LFPIORPI);
- For the administration of the contract entered into with "WTDS", including the performance of collection management;
- For the attention of claims, complaints, doubts, modifications and cancellations regarding the financing application, administration and termination of the financing contract;
- Confirm, verify, correct and update the information collected from applicants and clients;
- Make the charges that are appropriate for the concepts of membership acquisition; and,
- Carry out corporate collection management of our services.
Likewise, this personal information may also be used for the following secondary (non-essential) purposes:
- Offer you special rates;
- Statistical purposes; and,
- Advertising and marketing.
b) Financial and patrimonial data
Personal financial and/or patrimonial data such as: type of house inhabited by applicants, rental amounts, monthly income, other income and its source, credit card number, expiration date and security code of the same, will be collected to evaluate the economic capacity of applicants and, where appropriate, the granting and formalization of the financing requested by the client; as well as any information that is required to comply with the Federal Law for the Prevention and Identification of Operations with Resources of Illicit Origin (LFPIORPI), will be collected by "WTDS", through specific authorization forms, in which the express consent of applicants will be requested for the processing of their information, also explaining the legal consequences of their granting or, where appropriate, their refusal.
III. Transfer of personal data.
The personal data collected by "WTDS" may be shared with service providers that assist the company in the administration and management of financing contracts formalized with clients (including collection), which are necessary to comply with the provision of services that are contracted, so for this transfer it will not be necessary to have the express consent of the data owner, in accordance with what is indicated by article 37, section VII of the LFPDPPP.
Except for the cases indicated above and unless any of the assumptions contained in article 37 of the LFPDPPP is updated, the data provided by our applicants and borrowers will not be transmitted under any circumstances.
IV. Means to limit the use or disclosure of personal data.
In accordance with what is indicated in article 16, section III of the LFPDPPP and article 111 of the LFPDPPP Regulation, those people who wish to limit the use and disclosure of their personal data; or no longer wish to continue receiving communications in relation to the non-essential purposes detailed in this notice, may at any time send an email to the address: customerservice@wtdsinc.org requesting to stop being contacted for such purposes.
V. Revocation of consent and exercise of rights of Access, Rectification, Cancellation and Opposition.
In accordance with what is indicated in the LFPDPPP, as of September 1, 2025, the holders of personal data collected by "WTDS" may request access, rectification, cancellation (in case this is legally appropriate) or oppose the use of the same, as well as revoke their consent. To exercise these rights, you must follow the following procedure:
Send an email to our Privacy Office (data protection delegate) to the address: customerservice@wtdsinc.org in which you must indicate your full name, as well as the legal relationship you have with "WTDS" (borrower, applicant), the type of right to exercise (access, rectification, cancellation or opposition), precisely identifying the data for which you request said right, or those in which you decide to revoke your consent, attaching one of the official identification documents (INE Voter Credential, National Identity Card corresponding in the case of foreigners, Professional Card, Valid Passport or valid immigration document), in order to prove the identity or personality with which the request is made.
- In the case of personal data whose holders are minors or incapable persons, this request must be made by the person who legally represents the rights of the minor or incapable person, either through the accreditation of parental authority; or through their legally designated guardian or curator.
- Holders may attach the documents that are relevant to their request. For rectification requests, it is necessary to precisely indicate what modification should be made, attaching the documentation that justifies the appropriateness of the request.
- Requests for the exercise of ARCO rights must be submitted during business hours and days in accordance with the Federal Administrative Procedure Law.
- They must send the request to the email indicated in numeral 1) and they will be sent a receipt acknowledgment with the corresponding reception date. In case it does not meet the legal requirements, within the five business days following its receipt they will be required to correct their request, to answer within a period not exceeding 10 business days, if they do not do so, it will be considered not presented.
- In case your request has been sent on Friday or on a non-working day, it may be received from the business day following the one you sent it.
- The request will be answered via email within twenty business days counted from the date of receipt acknowledgment or receipt of your correction document as the case may be. This period may be extended for twenty additional business days when there are causes that justify it, this situation will be notified to the holder in accordance with what is established by article 97 of the LFPDPPP Regulation.
- In case the request is appropriate in accordance with the LFPDPPP and other current regulations, access will be granted, the data will be rectified or canceled, the right of opposition will be made effective or the consent will be considered revoked, within the fifteen business days following the date on which the request is answered. This period may be extended for fifteen additional business days when there are causes that justify it, this situation will be notified to the holder in accordance with what is established by article 97 of the Regulation of the Federal Law for the Protection of Personal Data in Possession of Individuals (RLFPDPPP).
- In all cases where the request is appropriate, in terms of what is indicated by articles 32, 33, 34 and 35 of the LFPDPPP, the delivery of personal data will be free through the email address that the data owner indicates for such purposes, in case you require that the information be delivered in a different way, you must cover only the justified shipping costs and/or the cost of reproduction in copies or other formats that are generated.
VI. Handling of Personal Data Online.
This section indicates the characteristics of the processing of personal data of users of our website.
Online Privacy Policy
The "WTDS" portal records information from internet users who enter and "browse" it, recording: the internet address of people (this address is, as a general rule temporary; and is assigned by the user's internet service provider at the time they connect), the type of operating system they use and the type of browser software they use. Additionally, the portal sites you are visiting can be tracked. The information we obtain is used to help us create a better experience for users of our Internet portal; this entire process is done without us having knowledge of the name or any other information that allows us to identify users. While they visit the "WTDS" portal, they do so anonymously, unless the user himself decides to expressly identify himself with us.
"WTDS" does not require users to reveal personal data to use the Internet portal, unless this is necessary to prove their status as applicant or borrower, which will be explained expressly. Some applications may require users to reveal some personal information such as in contact forms; all this with the purpose of attending to comments, requests, doubts or suggestions, or contacting them in case it is necessary. Within the contact forms, they will not be required to provide financial, patrimonial and/or sensitive data, so their disclosure is their responsibility. Notwithstanding the above, in case users voluntarily provide personal data classified within these categories, "WTDS" ensures the strictest confidentiality in its handling.
Cookies: The cookie is brief information that the Internet portal sends to the user's computer, which is stored on the hard drive. The next time the user enters our portal, we can use the information stored in the cookie to make it easier to use our website. For example, we can use the cookie to store a password so you don't have to enter it again every time you move to a different section of the portal. A cookie does not allow us to know the personal identity of the user; unless expressly choose to provide it to us. Most cookies expire after a certain period of time, or can be deleted by the user on their machine at the time they wish. Likewise, users can make their browser notify them when they receive a cookie so they can accept or reject them.
VII. Before whom can you file your complaints and reports for improper processing of your personal data?
Those holders who consider that their right to protection of personal data has been violated by some conduct, action or response to their requests, or presume that in the processing of their personal data there is some violation of the provisions provided for in the Federal Law for the Protection of Personal Data in Possession of Individuals, may file the corresponding complaint or report before the National Institute of Transparency, Access to Information and Protection of Personal Data (INAI). IX. Changes to the Privacy Notice.
This Privacy Notice is in effect as of September 1, 2025 and may be modified at the discretion of the responsible party, by publishing a new Privacy Notice on this website. You can verify the date of the notice version at the bottom of this document.
